Cancelling Purchase Contract
I recently put a contract on a home that is a short sale in January. The buyer is now trying to pull out of the contract. She has applied for a modification loan and was approved. The listing agent is saying they did not recieve any contract for purchase. The contract was taking to the listing office in person with earnest money in the amount of $2000 . What are my chances of buying this house? Is there any thing I can do legally?
Generally, contracts for transactions in Real Estate must be in writing. First you must find the "contract" , there are ways to make something, like a check, serve as a writing for contract purposes, but you do need something. Without more to go by, that's all I can tell you. Except, do not misunderstand that my remarks are not to be taken as legal advice, and that you do need to contact a lawyer regarding this matter. There legal rights involved and you should not make any decision regarding this matter without legal counsel.
