Home Heating Oil tank

When I bought my home 16 years ago, it was inspected by an FHA inspector.  He said nothing to me about the old fuel oil storage tank in the crawl space.  Maybe it was empty?  Not sure.  I have my house on the market and the storage tank is still in the crawl space.  I've contacted the EPA, the Illinois EPA and our city regarding the tank.  None of them seem to be concerned about it.  The realtors all want me to disclose that to potential buyers.  If the above 3 agencies aren't concerned, why make an issue out of it to buyers?
Your REALTORs are protecting you.  You can't be sued for anything (regardless of who considers it a defect or not) that you yourself disclose.

Old oil tanks are regulated by the federal EPA.  They should be removed.  The local guys don't always know this because they are not responsible for this.
